How Nigeria lost $28bn oil revenue — 99% of 2019 budget

In the last 10 years, Nigeria may have lost revenues as high as $28.61 billion, from failure to review the Production Sharing Contract (PSC) terms guiding oil production from seven deepwater fields in the country.
This projection was made in a policy brief released by the Nigeria Extractive Industries Transparency Initiative (NEITI) on Sunday.
The document titled “1993 PSCs: The Steep Cost of Inaction”, showed that the federal government was denied oil revenue that would have been earned between 2008 and 2017 if the contracts were reviewed in line with applicable fiscal terms.
PSCs are agreements where oil companies bear the risk and cost of exploring for hydrocarbon resources covered by its licence, and subsequently recovers its operational costs from what is produced.
The Nigerian National Petroleum Corporation (NNPC) enter these agreements with International Oil Companies (IOCs) through their Nigerian subsidiaries and sometimes with indigenous oil companies.
Under the fiscal terms of the agreements between the IOCs and NNPC, the companies are under obligation to pay royalty oil and tax oil to the Department of Petroleum Resources (DPR) after which the other parties to the contract share the profit oil.
Quoting section 16 (1) of the Deep Offshore and Inland Basin Production Sharing Contracts Act Cap. D3. LFN 2004, the NEITI brief showed that the fiscal terms for the PSCs between NNPC and IOCs “ought to have been reviewed” on two occasions.
First, in 2004 when real oil prices exceeded $20 per barrel, and most importantly, 15 years after the 1993 fiscal terms were launched, which should have been January 1, 2008.

AKPO, AGBAMI RECORD BIGGEST LOSSES

Using financial modelling analysis, the study examined oil production data from the seven fields, oil prices, and newer fiscal regimes, to arrive at estimated revenue figures for the period under review.
The seven deep water fields considered are Abo (OML 125), Agbami-Ekoli (OML 127 & OML 128), Akpo & Egina (OML 130), Bonga (OML 118), Erha (OML 133), Okwori & Nda (OML 126), and Usan (OML 138).
The field operators include, but are not limited to, Eni, Total, Shell, Chevron, Famfa Oil, Exxon Mobil, Petrobras, South Atlantic Petroleum and Addax petroleum.
The NEITI brief showed that under the fiscal terms of the 1993 PSCs, total revenue from the seven fields amounted to $73.78 billion.
If the terms of the 2005 PSCs had been used, however, total government revenue from these fields would have amounted to $89.81billion, meaning that $16.01 billion was lost in the review period.
Out of that, the Agbami field located in OML 127, operated by Chevron, Famfa Oil and Petrobras recorded the biggest loss.
Here, the government was denied revenue especially from profit oil and would have earned $22.15 billion instead of $17.72 billion, signifying a loss of $4.44 billion.
Depleting government revenues further, outdated fiscal terms on the Akpo field located on OML 130 and operated by Petrobras, South Atlantic Petroleum and Total, resulted in a loss of $3.22 billion.
Revenue was estimated to reach $9.54 billion instead of the $6.32 realised.
In percentage terms, there would have been a 50.91% increase in revenue from OML 130, if 2005 fiscal terms had guided the PSCs as against the 1993 fiscal terms applied.
In another scenario,  NEITI concluded that if the government was able to obtain profit share from all seven fields based on the terms of the 2005 fiscal regime, revenue would have hit $102.39 billion. This represents a loss of $28.61 billion.
In this scenario, revenues from Agbami would have increased to $31.51 billion, representing a huge loss of $13.79 billion within the 10-year review period.

LOST REVENUE COULD FUND MAMBILA POWER PROJECT

Based on the empirical evidence provided in its policy brief, NEITI said the billions of dollars in lost revenue would have been used to fund long-standing capital projects to deal with the nation’s infrastructure deficit.
“The lower threshold loss of $16.03bn to the Federation Account would have funded the Port Harcourt – Maiduguri rail line put at between $14bn to $15bn,” the NEITI document read.
“Other projects that the lost revenue could have been used to fund include the Mambila Power Plant of 3,050 MW at $5.72 billion, while the estimated cost of the Ibadan-Ilorin-Minna-Kano Standard Gauge line is $6.1 billion.
“The combined cost of these projects is $11.82 billion, which is less than the lower threshold of estimated losses.”
Other projects listed by NEITI includes “the Calabar-Lagos Rail line ($11 billion), Fourth Mainland Bridge ($1.4 billion), Badagry Deep Water Port Complex ($1.6 billion), and Lekki Deep Seaport ($1.2 billion).”

REVENUE LOST COULD FUND 2019 BUDGET

The higher estimated loss of $28.61 billion, according to NEITI, can fund 99 percent of the proposed federal government budget for 2019.
The N8.83 trillion naira budget ( ($28.80 billion) was presented by President Muhammadu Buhari to the national assembly in December 2018.
The total projected revenue, according to Buhari, is N6.97 trillion, consisting of oil revenue projected at N3.73 trillion, and non-oil revenue estimated at N1.39 trillion.
But with the loss recorded from the outdated PSCs, government may have to resort borrowing in its struggle to fund the capital projects outlined in the 2019 budget.
In its recommendation, NEITI charged the federal government to use relevant agencies to “immediately” review the “outdated PSC terms” with oil companies.
The NEITI brief noted that the affected companies “have expressed willingness to negotiate these terms” and should therefore be carried along in the review process along with state governments.

Bishop Oyedepo speaks on Buhari’s victory, mocks politicians


Presiding Bishop of the Living Faith Church, also known as Winners Chapel, David Oyedepo has broken his silence on the outcome of the presidential and National Assembly elections held across the country penultimate week.

According to him, it was shameful that politicians were celebrating an election that was marred with widespread rigging.
Addressing his congregants yesterday at the Church headquarters in Ota, Ogun State, the Bishop mocked the irregularities that riddled the exercise in some polling units.
However, he prayed Nigeria would not experience another war as a result of the remaining elections.
Oyedepo said: “Other developed countries around the world had developed their mode of voting into a digital method.
“But it’s a shame that in Nigeria, we still queue up to vote, and somebody would still be intimidated by thugs.
“With these, it’s a shame how politicians in this part of the world are proud of elections marred with rigging.
“In Covenant University, any student caught indulging in examination malpractice, is gone. It does not matter if his or her father is the head of United Nations or not.”

How Akpabio’s victory was stolen – Buhari


President Muhammadu Buhari, on Monday said that the votes of the Akwa Ibom people allegedly stolen during the Presidential and National Assembly elections of Feb. 23, would be reclaimed.

Buhari said this during a town hall meeting held in Uyo to thank the people of the state for casting their votes for the All Progressives Congress (APC) in the elections.
President Buhari, who was represented by the Vice-President, Prof. Yemi Osinbajo encouraged the people to defend their votes during the coming Governorship and House of Assembly Elections.
He decried the circumstances, under which Sen. Godswill Akpabio lost his re-election into the senate in spite of his popularity across the state.
He alleged that the Independent National Electoral Commission (INEC) robbed him and the party of victory.
He assured Akwa Ibom people that all the wrongdoings during the Presidential and National Assembly elections would be addressed.
“What happened on the 23rd of February was robbery. The votes of the people were stolen, but we are not deterred.
“The president sent me to thank you today. We are going to make sure that everything that was stolen on the February 23 would be restored.
“It is not possible that Sen. Godwill Akpabio lost. We are in no doubt that Senator Akpabio is the elected senator of Akwa Ibom North West Senatorial District.
“I and Adams Oshiomhole, the National Chairman of the party have been in the opposition for long and we cannot be defeated anymore.
“Everyone of you should go out to vote on Saturday and defend your votes, we cannot be cheated; not only you but tell your neighbours to vote for Obong Nsima Ekere and all APC candidates.
“Wait for your votes to be counted. It is the duty of the Federal Government to provide security and we will do that. We will recover every one of our votes, ” he said.
The National Chairman of APC, Comrade Adams Oshiomhole, said the party was not in the state to lament but to appreciate the people of the state for doing their jobs and voting President Buhari and Prof. Osinbajo.
He alleged that INEC colluded with some of the electoral officers to deny the state of its electoral victory on Feb 23, even though the people voted for APC.
“We have not come here to lament that our mandate was on February 23. We have come to thank you that you voted for President Buhari, and all members of the party. You did your job but some armed robbers in INEC stole your votes.
“You think that those who stole your votes will have peace? We have come to reaffirm our commitment with democracy.
“We have come to affirm that no robber will go unpunished, but when an electoral umpire is corrupt and collude with the opposition, we have the witnesses and we have lawyers to deal with that.
“On Saturday, we are not going to wait for them to steal out votes. We call on Akwa Ibom people to protect their votes. We must maintain our sanity even in this hour of provocation.
“Those who committed democratic abortion would be brought to book,” Oshiomhole said.

21-year-old man who killed female lawyer at a Lagos hotel arrested by police

 

The Lagos State Police Command says it has arrested a 21-year-old man who allegedly killed a lady, Feyitayo Obot, in her hotel room in Opebi, Ikeja.
According to a statement signed by the Command’s Spokesperson, CSP Chike Oti, the suspect claimed that he had sneaked into the deceased room to steal her money and not to kill her.
“On Jan. 26, 2019, the Lagos State Police Command received a report that one Feyitayo Obot, female, aged 34, was gruesomely murdered in her hotel room at Opebi, Ikeja, by one Joshua Usulor, male, 21 years old.
“Sequel to the report, the Command sent its homicide detectives to the scene of crime at Opebi, Ikeja, where they collected important exhibits for forensic analysis.
“The body, which had multiple stab wounds on the abdominal region and a throat slit open with a sharp object was recovered for autopsy.
“Although the suspect absconded after committing the crime, the State Commissioner of Police, CP Zubairu Muazu, charged the Deputy Commissioner of Police in charge of (SCIID), Panti Yaba, DCP Yetunde Longe, to leave no stone unturned in ensuring that the culprit is arrested and prosecuted.
“Painstaking investigation, however, led to the arrest of the suspect on Feb. 28, at his hideout in Victoria Island Lagos,” the statement read.
The News Agency of Nigeria (NAN) gathered that the suspect, during investigation, confessed to have committed the crime.
He said he had never met Ms Feyitayo Obot until the day he attacked her and that he was motivated to rob the deceased to enable him offset his hotel bill having exceeded his stay at an hotel.
According to the statement, the suspect claimed to have sneaked into the deceased room to steal her money and her phones but the deceased struggled with him but she was overpowered.
“He then stabbed her with a sharp knife on the stomach and used the same knife to slit her throat. Satisfied that the woman was dead, he made away with her phones and a cash sum of N26,000.
“Investigation revealed that the deceased was a lawyer who came to Lagos for a business meeting and lodged in a hotel at Opebi, Ikeja.
“The suspect will be charged to court for murder.
“Meanwhile, the Commissioner of Police has directed that the case file be duplicated and forwarded to the Directorate of Public Prosecution (DPP) for legal advice,” Oti said.
In a related development, one Amara Ezeodum, male, was arrested by policemen on anti-crime patrol at No. 66, Olaitan Sebanjo St., Lekki Phase 1, Lagos.
According to the statement, the cry of one Miss Oluwatosin Graig, who was robbed by the suspect, attracted the policemen led by CSP Isah Abdulmajid to the scene.
“The officers gave the accused a hot chase, arrested and recovered a gun from him,” it said.
The statement said the Commissioner of Police commended the efforts of the Anti-Crime Patrol team of Maroko Police Station and urged other police formations within the command to emulate them.

FG hails Usman for winning welterweight UFC belt

Senior Special Assistant to the President on Foreign Affairs and Diaspora, Abike Dabiri-Erewa, has congratulated US-based Nigerian kick-boxer, Kamaru Usman, for winning the Ultimate Fighting Championship (UFC) welterweight belt.
Usman, the ‘Nigerian Nightmare’ defeated long reigning champion American Tyron Woodley in Las Vegas on Saturday.
Dabiri-Erewa, said in a congratulatory letter to Usman, released by her Special Assistant on Media, Abdur-Rahman Balogun, on Monday in Abuja, that the victory was not only for Nigeria, but the whole of Africa being the first African fighter to win a UFC title.
“I congratulate you on this wonderful feat, for winning this fight not only for Nigeria, but for the African continent.
“We are truly proud of you and urge you to continue to use your professional prowess to extol the virtues of Nigerian heritage.
“Your shinning beacon serves as inspiration to the Youths of Nigeria,”Dabiri-Erewa said.
The Presidential aide urged Usman to continue to use his God given talent to benefit mankind, especially African youths in the Diaspora.
Nigeria is particularly honoured with the post tournament statement credited to Usman where he said, “Nigeria, I have told them, we will do it, I told them we never fail. And we have done it today,”.
The UFC is the biggest competition in MMA, where competitors combine boxing, kickboxing, jiu-jitsu, wrestling and other disciplines while fighting in an octagonal cage.
Usman, 31, produced the performance of his career to dominate long reigning welterweight champion Woodley.
He extended his winning streak to 14 and maintained his unbeaten record in the UFC.
Usman was born in Nigeria, but left Benin City for Arlington in Texas as a young child when his family migrated to the U.S.

Plea Bargain: Late Badeh loses 6 properties, $1m to Federal Govt

The late Chief of Defence Staff, Alex Badeh has lost six properties to the Federal Government and $1 million recovered from No.6 Ogun River Str., off Danube Street, Maitama, Abuja, through a plea bargain agreement entered with the Economic and Financial Crimes Commission, (EFCC).
This followed a judgment delivered by Justice Okon Abang at the Federal High Court, Abuja on Monday in a further amended charge brought by the EFCC where Badeh’s company was made the defendant following his demise.
The judge held that in view of the plea bargain agreement, the defendant was guilty as charged.
“I have before me a plea bargain agreement duly executed by Iyalikam Nigeria Limited and the EFCC.
“I hereby find the defendant guilty and accordingly convict the defendant of the 10-counts further amended charge.
“Having regards to the plea bargain agreement duly executed by the parties, Iyalikam Nigeria Limited is hereby wound up and the judgment shall be served on the Corporate Affairs Commission for execution,” the judge said.
Justice Abang also ordered forfeiture of a mansion situated at No.6 Ogun River Str., off Danube Str., Maitama Abuja, shopping mall situated at Plot 1386, Oda Crescent, Cadastral Zone, Wuse II Abuja and duplex located at No.19, Kumasi Crescent, Wuse II Abuja.
Others are a duplex at No. 14 Adzope Crescent, off Kumasi Cresent, Wuse II, Abuja, Semi-detached duplex at No. 8A Embu Str. by Sigma Apartments Wuse II, Abuja and $1 million recovered from No.6 Ogun River Str., off Danube Str., Maitama, Abuja.”
The judge further ordered that in view of the fact that the first defendant, (Badeh) was reported dead, all processes against him were hereby terminated.
At the resumed trial, the prosecuting counsel, Mr Oluwaleke Atolagbe said that the business of the day was for the second defendant to open defence since the first defendant(Badeh) was now deceased.
Atolagbe, however, informed the court that in view of an agreement reached between the prosecution and the defence, a further amended charge of 10 counts had been filed as well as a plea bargain agreement.
“My Lord, there is a development, the prosecution met with the defence and we have been able to reach an agreement.
“We filed a further amended charge dated March 1 and filed March 4 and we also filed a plea bargain agreement with regards to provisions of the Administration of Criminal Justice Act, (ACJA).”
Atolagbe asked that the new charge be read in the open court and in view of the plea bargain agreement, a guilty plea be entered for the defendant, (Iyalikam Nigeria Limited) by the court.
Following the reading of the ten count amended charge and the plea of guilty entered for the defendant by the court, the lawyer prayed the court to enter judgment based on the plea bargain agreement.
“For the avoidance of doubt, we ask that the court should order, as part of the sentence, the final forfeiture of all the properties affected in counts one to ten in the further amended charge as reflected in the plea bargain agreement.
“We further pray that the defendant be convicted and wound up based on the plea bargain agreement and Section 19 of the Money Laundering Act.”
Until his death, Badeh was standing trial on charges of alleged abuse of office, money laundering and converting public money to personal use to the tune N3.9bn.
He was arraigned along with his company on a 14-count charge bordering on fraud, to which he entered a “not guilty” plea to all counts.
The diverted money was said to have been meant for arms purchase in the face of worsening destructions by Boko Haram terrorists.

Lagos: Ifeanyi Ubah, TAN endorse Sanwo-Olu, promise Igbo votes

The Transformation Ambassadors of Nigeria (TAN) has endorsed the candidate of the All Progressives Congress (APC),
Mr Babajide Sanwo-Olu
for the Lagos State Gubernatorial elections.
In a briefing by TAN Secretary General, Mr Chidi Omeje and National Coordinator Ifeanyi Ubah on Monday, the group said that they were mobilising Igbos and other Lagosians for the APC candidate.
TAN said that the endorsement was a welI-thought decision that had become exigent after extensive deliberations and consultations with key stakeholders in Lagos state while giving due consideration to the manifesto of every contestant.
He said that the group had no doubt that Sanwo-Olu represents the “next level” Lagos state was in dire need of.
“Sanwo-Olu antecedents speak volume of his rare qualities, transparency, financial discipline, accountability and fairness.

He described the endorsement as a discussion of people’s interest and TAN’s interest.
“TAN is a national platform but also we have our ethnic structure.
“For the Igbo in Lagos we are speaking for them, we have consulted them widely. We have told them why it is important to support APC structure and to vote in Sanwo-Olu come Saturday.
“Visible work starts tomorrow but we have done some underground work prior to this press briefing.
“The most important thing is that we will not want to have friction with the Yoruba or any other ethnic group in Lagos. I think we are coming in at this point in time to swiftly get involved by putting in a round peg in a round hole.
“You should know very well that if it were to be issue of party I will not be here speaking because I am mindful of anti-party as a candidate of YPP.
“I am here in the interest of our Board of Trustees and TAN structure, which have mandated me to speak on their behalf,” he said.

28-year-old woman docked for allegedly slapping ex-stepmother


A 28-year-old woman, Amaka Okolie, who allegedly slapped her ex-stepmother and destroyed her necklace worth N190, 000 during an argument on Monday appeared in an Ikeja Chief Magistrates’ Court
Okolie, who lives on No 4 Taiwo St., Mafoluku in Oshodi, Lagos, is charged with two counts of assault and willful damage but pleaded not guilty to the charge.
The prosecution alleged that the defendant slapped her ex-stepmother, Mrs Ngozi Okolie, willfully tore her dress and cut her gold necklace valued at N190, 000, during an argument over the complainant’s refusal to leave her father’s apartment.
Police Sgt. Michael Unah told the court that the defendant committed the offence on Feb. 18 about 8. 40 a. m. at her residence.
He added that the defendant wanted the complainant, who was once married to her father but still occupied a room in their home, to leave but she declined.
“The defendant told the complainant that all her father’s property belonged to her mother because the complainant was no longer married to her father.
“The complainant refused to leave the house, this led to an altercation and the defendant slapped her, ripped her dress and destroyed her gold necklace worth N190, 000,” he said.
The offence, he said contravened the provisions of sections 173 and 339 of the Criminal Law of Lagos State 2015, (Revised).
Both sections prescribe three years imprisonment for offenders.
Chief Magistrate A. A Fashola, admitted the defendant to bail in the sum of N50, 000 bail with one responsible surety in like sum.
Fashola ordered that the surety must be gainfully employed with an evidence of two years tax payment to the Lagos State Government and have his address verified by the court.
The Magistrate adjourned the case until March 20, for mention, NAN reports.

Rochas Okorocha, governor of Imo state, says he has sacked Adams Oshiomhole, chairman of the All Progressives Congress (APC), for anti-party activities.
Reacting to his suspension from the ruling party by the national working committee (NWC) of the party led by Oshiomhole, Okorocha said the chairman lacked the power to suspend him.
He said as a founder of the APC, he could say authoritatively that Oshiohmole was involved in anti-party activities.
He spoke on Sunday Politics, a programme on Channels Television.
“I just heard from media reports that I have been suspended from the party (APC). I think Adams is seeking for relevance and attention,” he said.
“He doesn’t have such powers to remove somebody without following due process. I think Adams is the biggest player of anti-party in APC. The man has simply destroyed the party to a great extent.
“So, I have sacked him from the party. If he thinks he can just stand up and say he has suspended me from the party I founded, without following the due process, in the same manner, I have sacked him from the party.”
He accused Oshiomhole of imposing Hope Uzodinma, APC guber candidate in Imo on the party.
“The candidate that Oshiohmole imposed on the party in Imo State lost his votes for the Presidential election and all the members of the coalition in Imo State worked for PDP,” he said.

Dividend of looting !! Joshua Dariye reportedly down with kidney failure


Former Plateau State Governor Joshua Dariye is said to be down with renal failure.
The Nation reports that Dariye is currently hospitalised at the University of Abuja Teaching Hospital, Gwagwalada.
The paper quoted a government source, who pleaded not to be named, as saying that Dariye needed prayers.
The source said: “I have gone to see him. He is having serious health challenges. From my finding and from the doctor, his ailment is kidney failure and it is critical.”
The Nigeria Prisons Service (NPS), FCT Command Public Relations Officer (PRO), Chukwuedo Humphrey, confirmed that Dariye is hospitalized, but he declined to state his ailment.
He said the Service had been managing his illness since last October.
Humphrey said: “I will not mention the name of the illness to you and the hospital where he is. Normally people whose health we can’t manage we refer outside for proper medical attention. We have been managing his illness since October/November.”
Asked when Dariye will be discharged, the NPS spokesman said: “It is the doctor who knows when he can be discharged. We have now limited the number of people visiting him at the hospital. We are just allowing his wife, close family and friends, and law enforcement personnel. Tight security is around him just as if he is in the prison cell.”
“His wife is always allowed around him. And she is always full of praises to the NPS for the proper medical attention. And his court hearings are ongoing, he does not need to appear in court. His lawyers are there to defend him.
“Because of his health challenge, he opted for self-feeding. Because we cannot be cooking any special food for him. His family brings food for him.”

Policeman seeks end to 25-yrs-old marriage over wife’s sexual escapades with pastor


A 43-year-old police officer, Mr. Folorunso Adelana, has dragged his wife of 25 years before a customary court in Akure, the Ondo State capital, seeking dissolution of the union for alleged sexual escapades with her pastor.
The petitioner who accused the wife, Mrs Folashade Adelana of promiscuity is seeking dissolution of the marriage which had produced four children.
Mr Adelana, the police officer, told the court that he was no longer interested in the union.
In his oral evidence before the court, he accused his estranged wife of having an affair with the pastor of her church.
He alleged that his wife has been going out with the pastor for a long time, saying it was since their first child was still a small boy.
Adelana said, “I traced my wife down to the church and I didn’t meet her there. I called my wife and we started fighting. To my amazement, when the pastor got there and saw us fighting, he said, “is this the first time a pastor would be dating his church member?”
He further told the court that he once caught his wife in the pastor’s car and dragged her out, while he warned the pastor to stop going out with his wife.
”I was forced to bring her to court, thinking she would be afraid and comply with my instructions. But instead, she became worse.
However, the respondent, Mrs. Folake Adelana, a mother of four children aged 25, 13, 9, 7 respectively, debunked her husband’s claims.
Folake, an hair dresser, told the court that truly, she used to attend same church with her husband’s second wife, but she later left.
The respondent therefore urged the court to order her husband to pay their children school fees and also cater for their food and shelter.
The case was adjourned till March 4, 2019 by Chief R.A. Olusanya, the presiding judge.
